Apple claiming iPhone 3G is really fast deemed false by UK regulators

The UK s Advertising Standards Authority determined today that an Apple TV ad s claims about its iPhone 3G s relative download speeds is misleading and exaggerative, and must be pulled.

The ASA received 17 complaints from television viewers who believed Apple s So what s so great about 3G? ad for the company s latest iPhone inaccurately portrayed the speed of the iPhone 3G. In the ad, Web pages are loaded in a fraction of a second with a voice-over stating four times that news, directions, and the Internet are each really fast.

According to the ASA, this ad violates three sections of the BCAP TV Advertising Code:


5.2.1 Licensees must obtain adequate objective evidence to support all claims
, in this case, the accuracy of the portrayal of the 3G iPhone s speed.

5.2.2 Descriptions, claims and illustrations must not imply attributes, capabilities or performance beyond those that can be achieved in normal use.

5.4.1: Advertisements must not use any technique that is likely to give a misleading or unfair impression of the product or service.


Apple s response was that the ad was clearly comparing the 3G s speed against its 2G predecessor, and that the average viewer, as a mobile phone user, would understand the device s performance would vary. It said it reinforced that understanding by including the on-screen fine print, Network performance will vary by location.

The ASA, however, determined that there was no explicit comparison with the 2G iPhone, and that the visuals in combination with the repeated claim really fast, was likely to mislead viewers. Therefore, it declared, the ad as seen here must no longer be aired in the UK, and must be altered or retired.

Judge tosses Psystar s monopolistic power claim against Apple

A federal judge yesterday dismissed Psystar s claims that Apple is violating the Sherman and Clayton Antitrust Acts. But the Mac clone maker is not yet entirely down for the count in court.

Is Apple engaging in monopolistic practices to keep other companies from selling machines running Mac OS X? A federal judge this week approved Apple s motion to throw out a lawsuit making this claim, levied by Mac clone maker Psytar.

As previously reported in BetaNews , Psystar filed its own lawsuit in August after getting hauled into court by Apple on accusations of trade infringement and breach of contract around selling computers that run a version of OS X.

More specifically, Psystar contended that Apple has broken the Sherman Antitrust Act by tying OS X to Apple-labeled hardware and the Clayton Antitrust Act by carrying out monopolistic practices and exclusive dealings.

In early October, though, Apple s lawyers sought a dismissal of Psystar s suit, filing a 23-page motion charging Psystar with making an an attempt to direct attention from infringing conduct.

On Tuesday of this week, Judge William Alsup upheld Apple s motion to dismiss Psytar s suit.

Psystar, however, does have the opportunity to amend its lawsuit against Apple and to ask the court for reconsideration within 20 days.

At the end of October, Psystar announced that it had beat Apple out the door with a Mac desktop PC featuring an optional Blu-ray drive .

Guilty pleas may not be the end for TFT-LCD makers in collusion case

Wednesday s announcement by the Justice Dept. that three international LCD panel manufacturers will plead guilty in a price fixing scandal, could result in the resumption of civil proceedings against them.

LG which had been doing business jointly with Philips , Sharp, and Chunghwa -- three of the world s major producers of LCD displays -- will plead guilty to specific charges of conspiracy to artificially prop up the wholesale prices of their products, from the spring of 2001 to the winter of 2006. This despite the fact that those prices were on historic declines throughout that period.

The guilty pleas may represent the harvesting period, rather than the outright end, of an international investigation begun in December 2006 , which also involved NEC, Sharp, Seiko, Toshiba, and Hitachi. The DOJ, in cooperation with its counterparts in South Korea, Japan, and Europe, launched an investigation two years ago into whether essentially the entire world s producers of LCD displays made agreements with one another not to compete on price.

In one example cited by the DOJ, Sharp soon to become part of Panasonic, which was part of a joint venture that was also part of the investigation will apparently allocate to having conducted discussions with its competitors about how much it should charge clients including Dell, Apple, and Motorola.

The wholesale price any company charges its major corporate clients has direct bearing on the prices it charges its smaller clients; and in US District Court in San Francisco Wednesday, some of those clients -- the total number of which could extend into the dozens -- filed motions that would enable their civil cases against their suppliers to proceed. Many of those cases were filed in the spring of 2007, when the international investigation started to bear fruit, but were suspended on judges orders pending the outcome of the DOJ investigation.

Although the complete investigation is presumably nowhere near complete, the fact that three major targets will admit to being conspirators, may serve as evidence that a global LCD-TFT cartel did indeed exist.

LG has agreed to pay a fine of 400 million, the second highest ever to be attained by the DOJ s Antitrust division. Sharp will pay 120 million, and Chunghwa has agreed to pay 65 million.

Is Live Search Cashback really paying off for Microsoft?

Aside from generating savings for participating shoppers, Microsoft s Cashback program is drawing more advertisers and higher conversion rates for Live Search. But is Microsoft boosting its search share against Google? Quite possibly not.

It s costing Microsoft a bundle. But the Cashback program for Live Search might possibly be helping to meet a self-identified need to boost the company s position in the search market versus Google. The answer depends on what s being measured, and by whom.

Under Cashback, shoppers who buy consumer electronics, computers, clothing, and other goods located through Live Search searches get discounts from Microsoft of anywhere from around two to 15 percent on prices that have often already been reduced by retailers, anyway. Once the Live Search savings reach 5.00, Microsoft hands the money back directly to the consumer, paying out through the user s choice of check, direct deposit, or Paypal.

Using technology gained through Microsoft s Jellyfish buyout, Cashback was born last May . Before and since, Microsoft CEO Steve Ballmer has made very public about Microsoft s wishes to unseat Google from its overwhelming lead in the search market. At a speech in September in Santa Clara, CA, Ballmer reportedly said that Microsoft will keep sticking to that goal, even if it takes a lot of time and money. But he also said that, in order to succeed, Microsoft will need to redefine the search category.

On Thursday, Microsoft said it has been taking in an average of 4.5 million unique Cashback visitors per month since starting the program -- and that the number of products now offered through Cashback now totals around 1.3 million. And in other statements that aren t that difficult to verify, Microsoft said that 20 of the top 50 online retailers in the US and 140 of Internet Retailer s top 500 are now taking part in the program. New advertisers such as ATT, Drugstore.com, Banana Republic, Kmart, and Saks Fifth Avenue were mentioned.

But Microsoft also announced that since the program s rollout in May, Cashback has shown positive traction on three key metrics: number of offers in the system, advertiser return on investment ROI , and percentage of commercial search queries as measured by Comscore, Inc.

The press release didn t directly define what the reference to commercial search queries means. Nor did it provide any metrics from comScore or other sources as to search share as typically measured by the firm. Microsoft seems to be referring not to conventional search share but to some new category of metrics just invented -- or maybe, as Ballmer might put it, redefined.

Cleverly tucked into Microsoft s press release is the following paragraph:

In addition, according to a custom comScore study emphasis ours , in the second quarter of 2008, Microsoft Live Search referred almost 12 percent of total U.S. commercial online transactions and about 13 percent of total U.S. online spending among key retail categories. Microsoft Live Search placed among the top two U.S. engines in five of the 10 key commercial categories for conversion rate, including Computer Hardware, Movies Videos, Home Garden, Music, and Travel. Microsoft Live Search also shows a competitive advantage in attracting high-quality and high-spending buyers. Microsoft Live Search ranked as the top engine among the competitive set by a large margin in dollars spent per buyer, across the combined 10 key commercial categories.

In a press release issued last August , comScore said that Microsoft s share of searches at US home work university locations actually dropped, from a total of 9.2 in June 2008 to 8.9 in July.

For its part, Experian-owned Hitwise reported in August that Microsoft s share of all U.S. searches -- including Microsoft s Live.com and MSN Search, but not including Club.Live -- amounted to 5.36 in July, a slight decrease over the company s 5.46 share in July of 2008 and an even larger fall from the 8.79 share received in August of 2007.

In September, Hitwise put out another press release, showing further slides for Microsoft in August from both the previous month and the previous year.

Neither comScore s nor Hitwise s statistics for successive months have yet been made available.

How to become a happy iPhone developer

Although some Apple developers are airing a lot of frustration lately, mDialog s Greg Philpott wants it known that he s basically happy about creating software for Apple platforms.

While iPhone software applications like Podster and Murderdrome have gotten nixed by Apple s App Store , thousands of others are indeed up there for download. A social video application from mDialog, available since the App Store s launch on July 10, is driving considerable new business for mDialog, said Greg Philpott, the company s founder and CEO. In an interview with BetaNews, Philpott also shared some tips for other developers interested in getting their software into the App Store.

For one thing, I d never try to build something that s already in iPhone. You want to be adding something unique, according to Philpott, who described himself as happy to be working with Apple.

To succeed in a business sense, you really need to get to know Apple, Philpott suggested. But he also gave examples of how Apple s third-party developers can wield influence within that relationship, in mutually advantageous ways.

mDialog s business model revolves around subscription-based storage, sharing, and delivery of high-def video content produced by end users ranging from video novices to pros. The company started developing for Apple platforms after licensing Apple s MPEG4 H.264 video encoding technology.

Its flagship app, mLoader, is designed to let end users encode, describe, and upload MPEG-4 H.264 videos in 960x540 HD directly from the Mac desktop. A client-side server design is used for converting the video during uploads to mDialog s Web site, so the video can go live right away, according to Philpott. The technology also supports Apple TV.

With its new iPhone app, mDialog is extending that approach to the mobile platform, letting users upload videos from their phones to mDialog s Web site for sharing through an e-mail-to-a-friend feature.

We were an existing Apple developer, and we already had a video delivery platform in place. We had support from Apple to produce a mobile application and to optimize it for iPhone. We applied as an Apple partner, and we were accepted, he told BetaNews.

On July 10 of this year, mDialog released the iPhone app, along with another new piece of software: a separate browser plug-in app. The iPhone app lets users rate, comment on, and vote on videos, as well as create personalized favorites lists.

How can other developers build apps that will make it into the App Store? According to Philpott, it s essential to start attending Apple developer conferences, particularly the World Wide Developers Conference WWDC held in Cupertino, CA each year. If you don t go to WWDC, I d say, Don t even bother. It s the best money you ll ever spend, he contended.

At the conference, third-party developers can meet, learn from, and exchange ideas with Apple engineers. This isn t a fan thing. You re face-to-face with the people who are actually writing the code, he said.

After you start developing, you can submit enhancement requests -- Apple s parlance for bug reports. After turning these in, we ve seen the fixes incorporated into new releases of Apple software, according to Philpott.

It also helps to follow the design guide that Apple gives to developers. In the interests of achieving a uniform look-and-feel across third-party apps, the guide gives what Philpott called strong suggestions from Apple about various app design issues, such as how to create list boxes.

But the suggestions aren t absolute requirements from Apple, the CEO noted.

The first time around with the iPhone app , we did default everything, he recalled. But since the release of the first version, mDialog s developers have produced two updates, tweaking the app along the way for improved video transmission over 3G networks.

Each update needed Apple s okay before getting posted to the App Store, but mDialog got approval after a few weeks each time. Although Philpott didn t say so, it would certainly seem in Apple s best interests for users to be able to send high quality video over a 3G connection.

Still, Philpott wishes that mDialog was able to list the dates of the revisions in the App Store, so people who downloaded the first release could find out about the software updates more easily. Instead, like other apps in the online store, mVideo s social video app is listed under the date it first appeared in the store, despite software updates.

But that s the way it has to be, really, Philpott said. He predicted that, otherwise, some developers might file an ongoing barrage of updates for no other reason than to keep their apps at the top of the App Store.

Philpott acknowledged that the iPhone SDK doesn t talk about Apple s kill switch, which was used recently to shut down developer Alex Sokirynsky s Podcaster application when he tried to use Ad Hoc App Distribution -- a feature of the iPhone iPod Touch platform -- to distribute the app himself.

But Android has a kill switch, too -- and Android Market can also get rid of applications, if it wants, Philpott added.

It s been widely reported that Google is warning its developers about a kill switch in Android, a new open source-based rival to Apple s iPhone platform. Also, just before T-Mobile s launch of its G1 -- the first Android phone to come to market -- Google took down most of its initial slate of 50 apps down for further testing, before returning all or most of them by the middle of the week.

Today, Google is expected to announce that its Android Market will open up to considerably more developers this coming Monday, and that Android developers will be able to start charging for their apps in January of 2009.

Meanwhile, though, developers don t even need to get their applications in to the App Store in order to distribute them for iPhones and other Apple platforms, Philpott said: You can always just build a Safari browser app, and get your software out to people that way.

Pricing and models for all Azure services will be competitive with the marketplace, says Ozzie. Azure service offerings will be directly through the web and existing channels and programs. More details will be provided as Microsoft gets closer to a commercial release.

10:07am PT: Extending software applications with Windows Azure: Thompson shows off how Microsoft Word can be integrated with CRM Online. Data can be immediately populated into a template, and then exported into SharePoint Services.

10:04am PT: With the federated identity feature of Windows Azure, the Microsoft Services Connector automatically authenticates users. This means that Windows users won t need to login to Microsoft Online Services. Thompson demonstrates how he can launch CRM Online and be immediately logged in.

10:01am PT: Windows Azure services have been designed to extend existing software tools, not necessarily replace them, but it is possible in the case of Exchange and others. Thompson is explaining how each Microsoft Online Services solution can be extended with software.

9:52am PT: Muglia: Windows Azure is a new platform, but it leverages Microsoft s existing tools. He says will be taking the capabilities of Windows Azure and putting them into SQL Server, Windows Server, and other software tools.

Muglia has also introduced Oslo, which will be distributed to developers at PDC. Oslo a platform for modeling distributed applications.

Oslo is going to have some very important ramifications for the industry, says Muglia. It incorporates a new language called M that allows models and domain specific languages to be defined.

9:47am PT: Muglia: For a while now we ve been working on a project code-named Atlanta.

Atlanta is built upon Azure and appears to be an online version of System Center . Enterprises can use Atlanta to monitor their server environment with metrics. It can create charts with Silverlight and is fully managed via the Cloud.

Azure uses Microsoft s Windows Hypervisor technology. It employes multiple level of security code access, IP filters, firewalls, VLANs, and Hypervisor enforced isolation .

Unlike traditional OSes that manage a single machine. Windows Azure as the operating system for the cloud manages the entire cloud.

Windows Azure separates the app from the OS. At the heart is a Fabric Controller that manages the lifecycle of the app from deployment to updates. When you want to change your service, you specify the design and state and the Fabric Controller makes the necessary changes, Srivastava explains.

The Software and Systems Quality Conference SQC , at London s QE11 Conference Centre in Westminster is one of Europe s leading international conferences on software quality management, testing and process optimisation. The ISTQB Foundation exam is equivalent to a GCSE, and the Advanced Practitioner to an A Level. So, IT students should know this before they leave school!

ControlCircle takes to the streets to raise money for Action...

September 29, 2008 ControlCircle, the datacentre services company, is raising money for Action for Children by taking part in this year s Byte Night, the IT industry s annual sleep out which supports the nation s most vulnerable young people and their families and highlights the whole issue of youth homelessness...

ControlCircle s chief executive officer, Damian Milkins, along with Ben Radomski, corporate communications manager, will give up a night in bed, take to their sleeping bags and sleep out in Potter s Field, near London Bridge.

In 1998, just 35 people slept out and raised 35,000. Since then, Byte Night has grown to become nationwide with this year s event on Friday October 3, 2008 expected to see 500 people in London, Edinburgh, Birmingham, Manchester and the Thames Valley taking part to raise what is hoped will be 500,000 to fund vital Action for Children projects.

Ken Deeks, founder of Byte Night, says, The idea for Byte Night came to me when I saw an Action for Children poster on the Underground seeking funding to help end youth homelessness by the millennium. At the time, the IT industry was making huge sums of money on Y2K bug fixes so I thought I d put the two together and get a hugely rich industry to support a charity which had a pressing need for assistance to solve a really important social problem.

While much has been done to reduce it, at least 75,000 children and young people experienced homelessness in the UK in the past year, in other words 1 out of every 100 person aged between 16 and 24. 1 The reasons for this are complex but typically result from young people leaving the care system, trauma during childhood or having to leave home because their parents will not accommodate them. And the effects are significant. A third of all young homeless people attempt suicide and, according to the Home Office, 70 are diagnosed with depression or other mental health disorders, or have concerns about their mental health. 2

Damian Milkins, ControlCircle s chief executive officer, says, Frankly most of us have the unconditional support from family to cope with life ups and downs. No, Freecharts lets you export your data for use in (almost) any other program package. I say almost, because some programs are only able to use data purchased from the same people who sell the software.
How come I've never heard of FCharts or Spacejock? I registered Spacejock Software in 2001, and have been selling my charting program under that name ever since.
I don't advertise, and I'm not into self-promotion. I put my effort into pleasing existing customers, and I would estimate that 90% of my customers are using FCPro because it was recommended to them by someone else. If that sounds like a crazy way to sell a product, you're right - only I'm not selling a product, I'm developing a better charting software with the cooperation of thousands of dedicated users.
Why is Freecharts SE free?
I don't like adware, so I decided to make a cut-down version of my program available to everyone, free. It's fully functional with no limits, and if you decide to upgrade to the Pro version you can even re-use your database and settings. (You don't have to upgrade, but every sale helps to fund further development). You can also run a 7-day trial of the Pro version, which reverts to SE when the trial period is up. (You don't lose your data or settings at that point.)
Do you supply data?

FCharts doesn't actually 'know' what it's charting, so you can use it with anything provided the data is in the right format. Details of data import formats are in the help file accompanying the program, and it's not hard to create a suitable file in a spreadsheet package or text editor.
How do I keep the stock prices up to date?
You need a daily update called an 'End of Day' data file, or 'EOD' file for short. A number of online brokers offer these files to their customers, and there are sites where you can download them for free. You can also subscribe to a data service. (See the Data FAQ for more details.) I recommend most users start with a free data service until they're comfortable with the program, and then subscribe to data after that.
How do I get hold of updates?
Download and install the 'FCharts' update from the FCharts updates page. This will update both FCharts SE and/or Pro at the same time. You can also use the program's inbuilt updater - just click the 'Settings' button on the main screen, followed by 'Check for Update'
How fast is the data import?

Microsoft launches its own blog for 'Windows 7'

The official marketing channel for the next edition of Windows was opened this afternoon, as Microsoft quietly raised the curtains on what it's positioning as an open channel for ideas regarding what the company should add to its next OS.

In their initial post to the "Engineering Windows 7" blog this afternoon, its two hosts -- Windows senior vice presidents Jon DeVaan and Steven Sinofsky -- acknowledged that their company will indeed divulge the first engineering details about Windows 7, as it's still being called, on October 27 at the Professional Developers' Conference in Los Angeles.



Borrowing a metaphor from one or more presidential campaigns this season, Sinofsky and DeVaan promised readers the blog would be used for a "two-way conversation" with the enthusiast community.

"The audience of enthusiasts, bloggers, and those that are the most passionate about Windows represent the folks we are dedicating this blog to," they wrote. "With this blog we're opening up a two-way discussion about how we are making Windows 7... We strongly believe that success for Windows 7 includes an open and honest, and two-way discussion about how we balance all of these interests and deliver software on the scale of Windows. We promise and will deliver such a dialog with this blog."

The inaugural comment for this discussion came from user parithon, who noticed a little something missing: "I look forward to all the upcoming information but...who forgot the RSS feed? This feature is almost required for blogs today. I'm sure you know we're all too busy to refresh our browsers in order to find out if a new post has been published." (UPDATE: Such a feed now exists -- and actually may have existed all along -- at this address .)

Sinofsky was the Microsoft executive brought in from the Office division in March 2006 to help reassemble its Windows strategy. In a reorganization last month , his position was shifted around and redefined, so that he now reports directly to CEO Steve Ballmer rather than to CTO Ray Ozzie. DeVaan, meanwhile, had led some important projects at Microsoft including its IPTV projects.

After former Windows chief Kevin Johnson's departure to become CEO of Juniper Networks, DeVaan was scooted into a parallel position to that of Sinofsky. As the company now describes, Sinofsky is now in charge of engineering both the Windows and Windows Live platforms -- a job once thought to be spearheaded by Ozzie -- while DeVaan maintains responsibility for the "core" of the Windows OS.

Last May, Sinofsky was one of the first to speak publicly on the subject of Windows 7, telling reporters Microsoft still plans to maintain a three-year cadence for its operating systems. The lifespan for Windows Vista, he said at the time, began with its "general availability" as opposed to its release to manufacturing, which led many to conclude that Windows 7 would be scheduled for as soon as the winter of 2009. With that timeframe, serious beta testing and hardware compatibility engineering would have to begin immediately.

Facebook's global growth catapults it to #1 worldwide

New independent data shows Facebook enjoyed 153 percent growth year over year, while MySpace remains essentially flat. The site's growth is biggest overall outside of the US.

Overall, Facebook attracted 132.1 million unique users in June, compared to 117.6 million for MySpace, according to data from comScore released this week. Another site that saw impressive growth was Hi5, which doubled its unique userbase to 56.4 million.



ComScore's data seems to indicate that the market for social networking in North America has matured, showing only 9% year-over-year growth. But that's not the case elsewhere.

"The phenomenon is still growing rapidly in other regions around the world -- especially as the established American brands turn their focus to developing markets," the firm's executive vice president Jack Flanagan said.

Evidence of a large untapped global market can be found in the 66% growth rate in the Middle East and Africa, and 35% and 33% growth rates in Europe and Latin America, respectively.

MySpace is not taking part in the growth spurt, at least for now -- it has struggled to expand its business outside of the US. While it remains hugely dominant here, in many overseas countries it is barely registering.

Facebook is another story. Its growth is led by Latin America, which saw a eleven-fold growth rate: users jumped to nearly 12 million in June from just over 1 million a year ago. Similarly, Facebook more than quadrupled its user base in the Middle East/Africa and Asia Pacific regions, and tripled it in Europe.

Non-US users now make up an overwhelming majority of Facebook's user base -- 63%, in fact. This can likely be tracked to its efforts to localize the site: It's now available in some 89 languages, contributing to faster growth.

"By increasing the site's relevance to local markets through local language interface translation, the site is now competing strongly or even capturing the lead in several markets where it had a relatively minor presence just a year ago," comScore's Flanagan said.

Facebook's competitors seem to be pursuing a different strategy when dealing with international markets. Hi5 released tools to allow its users to localize the site into various languages, while supplementing it with its own work in translating services.

MySpace is doing things much differently. Instead of expanding everywhere and anywhere, it seems focused on developing markets where there are not only latent users, but also ad dollars. The company believes that this strategy is the more viable one for expansion outside the US.
